The National Tax Union and the Prosecutors Union advocate not only for labor issues, but also for \"institutional reforms to protect the rights of citizens,\" including the administrative and judicial systems.<\/p>\n\n\n\n
From that standpoint, we make one bold proposal.<\/p>\n\n\n\n
Administrative investigations have their own role.<\/p>\n\n\n\n
However, assuming that people evade explanation documents and are unable to ask questions during the inspection stage, and that the matter subsequently moves to criminal proceedings where prosecutors re-verify the circumstances and conduct interrogations, the question arises from the perspective of the public: \"Are the National Tax Agency's inspection departments necessary?\"<\/p>\n\n\n\n
Discussions on the visualization of interrogations, such as through audio and video recording, have been progressing year by year.<\/p>\n\n\n\n
Therefore, shouldn't we aim for a society where tax cases do not simply \"end with administrative investigations,\" but rather allow citizens to understand the system through judicial procedures with ensured transparency?<\/p>\n\n\n\n
Recently, the remark \"Don't underestimate the prosecutors\" has become a social topic of discussion, drawing public attention to the nature of investigative agencies and the appropriateness of interrogations.<\/p>\n\n\n\n
While the evaluation of individual cases should be left to judicial procedures, we believe that the spread of such discussions itself is a manifestation of the public's desire for a \"more visible judiciary\" and a \"judiciary that provides more explanations.\"<\/p>\n\n\n\n
The era is built on \"visible procedures\" rather than \"invisible authority\" to establish trust in the judiciary.<\/p>\n\n\n\n
Amid discussions surrounding news reports and public documents, the legal assessments within investigative agencies and the contents of internal materials sometimes attract significant public interest.<\/p>\n\n\n\n
Whenever such discussions arise, the importance of accountability\u2014specifically explaining \"what legal assessment was made\" and \"on what grounds that decision was reached\"\u2014is greater than ever.<\/p>\n\n\n\n
That is precisely why we believe the time has come to discuss the division of roles between administrative investigations and criminal procedures from the perspective of the general public.<\/p>\n\n\n\n
Our proposal is not intended to weaken the investigative authorities.<\/p>\n\n\n\n
It's quite the opposite.<\/p>\n\n\n\n
If the prosecution conducts proper investigations through highly transparent procedures and society reaches a point where the public can understand the process, trust in the judiciary will be further enhanced.<\/p>\n\n\n\n
Taxation is a system that concerns all citizens.<\/p>\n\n\n\n
That is precisely why the public has the right to understand that process, discuss it, and demand improvements.<\/p>\n\n\n\n
Do not avoid the question of whether inspections are necessary.<\/p>\n\n\n\n
We do not immediately reject the inspection system.<\/p>\n\n\n\n
However, if similar explanations and verifications are required in both administrative investigations and criminal procedures, examining their institutional design and division of roles is by no means a taboo.<\/p>\n\n\n\n
If you fail to comply with this, subsequent handling will be handed over to the prosecutors. However, prosecutors do not possess the specialized and large-scale personnel system of the National Tax Agency, and since they operate on the principle of in-person confirmation for all cases, the burden will be extremely heavy.<\/p>\n\n\n\n
As a result, the front lines will be overwhelmed with excessive work, and public interest and evaluation regarding the quality and attitude of their response will likely increase even further.
In fact, as remarks such as \"Don't underestimate the prosecutors\" have attracted public attention, we have entered an era where the very nature of investigative agencies is being exposed to the public eye.<\/p>\n\n\n\n
These kinds of situations can, as a result, strengthen demands for judicial transparency and serve as an opportunity to deepen understanding of and engagement with the prosecution. The very backdrop against which entities like our Prosecutors Union are expanding lies precisely in these structural changes.<\/p>\n\n\n\n
Inspection or visualization?<\/p>\n\n\n\n
That is not a binary choice.<\/p>\n\n\n\n
What is necessary is to evolve both the administration and the judiciary into systems equipped with transparency that is convincing to the citizens.<\/p>\n\n\n\n
